Terms of Service Effective Date: May 1, 2026
Please read these Terms carefully before using our services. Section 13 contains important information about dispute resolution, including arbitration.
1. Agreement to These Terms
These Terms of Service (“Terms”) form a legally binding contract between you and Our Happy Tree LLC (“Our Happy Tree,” “we,” “us,” or “our”), a Pennsylvania company based in Huntingdon Valley, Pennsylvania.
They apply to your access and use of our website (https://www.ourhappytree.com and any subdomains), mobile apps, pet care booking platform, online shop, and all related features (collectively, the “Service”).
By booking services, purchasing products, creating an account, or otherwise accessing/using the Service, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the Service.
We may revise these Terms occasionally. We will post updates on the Site. Your continued use after changes are posted means you accept the updated Terms.
2. Our Pet Care Services
2.1 Direct Provision of Services.
We directly deliver all pet care services available through the Service, such as boarding, dog walking, in-home sitting, and other care options.
2.2 Making a Booking.
A confirmed reservation (“Booking”) is an agreement for specific services, dates, and pricing shown at checkout. All Bookings require our acceptance.
2.3 Your Responsibilities as Pet Owner.
You must give complete and accurate details about your pet, including age, breed, health history, vaccinations, behavior, medications, and any special requirements. Your pet must be up to date on all necessary vaccinations and appropriate for the service. Incomplete or inaccurate information may lead to cancellation without a refund.
2.4 Late Pickup or Abandoned Pets.
If you do not collect your pet by the end of the agreed period, we may arrange alternative care (such as foster placement or animal control) at our discretion. You remain responsible for all additional costs, including extra boarding fees, transport, and veterinary expenses.
2.5 Medical Emergencies.
Please supply up-to-date emergency contacts. If we cannot reach you or your contacts during a medical issue, we may obtain veterinary treatment as needed. You agree to cover all related costs and authorize charges to your payment method. We are not liable for good-faith decisions made in emergencies.
3. Acceptable Use
You agree to use the Service only for lawful purposes and in a responsible manner. Prohibited actions include:
- Submitting false or misleading information about yourself or your pet
- Posting fake, harmful, or retaliatory reviews
- Harassing users, staff, or others
- Trying to bypass booking, payment, or security features
- Arranging services off-platform after connecting through us
4. Privacy
We handle your personal information according to our Privacy Policy, available at https://www.ourhappytree.com/privacy.
5. User-Submitted Content
Any photos, videos, reviews, or other materials you upload grant us a worldwide, royalty-free, perpetual, non-exclusive license to use, display, reproduce, and promote them in connection with the Service.
6. Payments and Cancellations 6.1 Charges.
You authorize us to charge your chosen payment method for all fees, services, and purchases.
6.2 Cancellation & Refund Policy (Services)
- Cancellations at least 72 hours (3 full days) before the start receive a full refund (minus any applicable non-refundable fees).
- Later cancellations are typically non-refundable.
- We may consider partial or full refunds for documented emergencies (e.g., serious illness or family death) on a case-by-case basis.
- Approved refunds process within 7 days to the original payment method.
We can cancel any Booking for health, safety, or operational reasons and will issue a full refund in such cases.
7. Intellectual Property
All materials on the Service—text, images, logos, designs, and software (except your uploaded content)—belong to Our Happy Tree LLC. You may not copy, modify, or use them without our prior written permission.
8. Disclaimers
The Service, pet care offerings, and products are provided “AS IS” without warranties of any kind. To the fullest extent allowed by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
9. Liability Limits
To the maximum extent permitted by law, our total liability for any claim related to these Terms or your use of the Service will not exceed the amount you paid us for the specific Booking or product involved. We are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages.
10. Indemnity
You agree to defend, indemnify, and hold harmless Our Happy Tree LLC, its owners, staff, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from: (a) your violation of these Terms, (b) your pet’s actions, (c) inaccurate information you provide, or (d) your misuse of products or services.
11. Suspension or Termination
We may suspend or end your access, cancel Bookings, or refuse service at any time if we reasonably suspect a violation of these Terms or if continued service could harm people, animals, or our operations.
12. Shop and Product Terms
12.1 Product Descriptions
We strive to provide accurate descriptions, images, and details of our products. However, colors, textures, and appearances may vary slightly due to lighting, screen settings, or the handmade nature of many items. All products are sold “as described” on the Site at the time of purchase.
12.2 Pricing and Availability
All prices are in U.S. Dollars and are subject to change without notice. We reserve the right to refuse or cancel any order for any reason, including errors in pricing or availability. If we cancel your order, we will notify you and issue a full refund.
12.3 Shipping Policy
- Shipping costs are calculated at checkout and vary by location, weight, and shipping method selected.
- We ship to addresses within the continental United States (unless otherwise specified).
- Orders are typically processed and shipped within 3–7 business days after payment is received.
- Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers.
- Risk of loss passes to you once the package is handed over to the shipping carrier.
12.4 Returns & Refunds (Products)
- We accept returns for most items within 14 days of delivery if the item is unused, in original condition, and in original packaging.
- Personalized, custom, or made-to-order items are non-returnable and non-refundable unless defective.
- To initiate a return, contact us at contact@ourhappytree.com with your order number.
- Returned items must be shipped back at your expense.
- Once we receive and inspect the returned item, we will process your refund (minus original shipping costs) within 7 business days to the original payment method.
- Defective or damaged items: Contact us immediately. We will replace the item or issue a full refund (including shipping) at our discretion.
12.5 Custom Orders
Custom and personalized orders require a non-refundable deposit (typically 50{2aecd35fcc4c24e4a7d7f62813126138e3502808798728f3b433c2ba452f7a80}) at the time of ordering. Production begins once the deposit is received. Custom orders have no cancellation or refund rights once production has begun, except for manufacturing defects.
12.6 Handmade Product Disclaimer
Many of our products are handmade. Slight variations in size, color, shape, or finish are normal and are not considered defects.
12.7 Product Use & Liability
Our products (especially pet-related items) should be used responsibly. Always supervise pets when using any product. We are not liable for any damage, injury, or loss resulting from misuse of our products.
13 Governing Law and Disputes
These Terms are governed by Pennsylvania law, without regard to conflict-of-laws rules. Any disputes shall be brought exclusively in state or federal courts in Montgomery County, Pennsylvania, and you consent to jurisdiction there.
We encourage contacting contact@ourhappytree.com first for informal resolution. Eligible disputes (excluding intellectual property or small claims) may proceed to binding arbitration in Montgomery County under American Arbitration Association rules.
14. General Provisions These Terms represent the full agreement between us. Invalid provisions do not affect the rest. Our failure to enforce a right does not waive it.
